The Dirty Dozen - As Reported by the IRS

Prospective clients often ask me if these refunds are legal. This is a legitimate question. The answer is - yes, they are legal. Think of the child tax credit as the American version of Israel’s monthly child allowance. Rather than a monthly stipend, the American government gives citizens a break on their taxes.

Not only are they legal, but many American citizens who do not claim their refund, simply because they neglect to file their returns, are in violation of the law! Married couples in 2002, for example, are required to file if they earn more than $13,850. This is true even if the couple will not owe any American taxes. See publication 54, page 3 for further details.

Nonetheless, tax scams do continue to find their mark, and the IRS continues to prosecute scammers. Listed below are the top twelve scams as reported by the IRS.

  1. Offshore Transactions.
  2. Identity Theft.
  3. Phony Tax Payment Checks.
  4. African-Americans Get a Special Tax Refund.
  5. No Taxes Withheld From Wages.
  6. Improper Home-Based Business.
  7. Pay the Tax, Then Get the Prize.
  8. Frivolous Arguments.
  9. Social Security Tax Scheme.
  10. "I Can Get You a Big Refund ...for a Fee!"
  11. Share/Borrow EITC Dependents.
  12. IRS "Agent" Comes To Your House To Collect.

Beyond the "Dirty Dozen," the IRS sees many more tax schemes. Some examples include home-based business scams, disabled access credit for pay phones and a variety of improper abusive trusts.
